Booking Terms and Conditions

SHORT TERM HOLIDAY LEASE AGREEMENT

Please make sure you are familiar with the terms and conditions of our bookings:

Quiet Hours

Guests must observe quiet hours from 10:00 PM until sunrise daily. During this time, all noise must be kept to a minimum, and no music or disruptive activities are permitted. These conditions are non-negotiable and in place to maintain respect for surrounding residents. 

Occupancy Limits

Our properties have a maximum number of individuals permitted to occupy the Premises during the Lease Term. If this number is exceeded without prior written approval from the Host, the Agreement may be immediately terminated, and all monies paid forfeited. 

No Caravans or Tents 

Guests are strictly prohibited from bringing or setting up caravans, tents, campervans, or any other forms of portable accommodation on or around the premises. Breach of this condition may result in termination of the booking and/or additional charges. 

Booking Fees

The Guest agrees to pay the Host the amount specified and agreed upon during the booking process. Payment in full is required prior to occupation. 

Utilities

The Host will cover all standard utilities for the Premises, with no exclusions. Use of utilities must remain within reasonable limits. Electric vehicle charging is strictly prohibited due to electrical load limitations and fire safety concerns. Unauthorized EV charging may result in a bond deduction and/or termination of the stay. 

Maintenance and Repairs 

The Guest shall maintain the premises in a good, clean, and ready-to-rent condition and use the premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings. 

Cleanliness on Arrival

Should there be any concerns with the cleanliness or presentation of the property upon arrival, guests must notify our team immediately to allow us the opportunity to rectify the issue. If we are not contacted at the time of arrival the guest acknowledges that the property is accepted as is. No refunds or compensation will be provided for cleanliness concerns raised later during the stay or after departure.  

Security Deposit Authorisation

A Security Deposit will be collected as part of the booking process. This preauthorisation is held as a guarantee against any breach of this Agreement. including but not limited to: damage, excess cleaning, lost items, or additional services required. The deposit will be released in accordance with local legislation, less any reasonable deductions. It may not be used in lieu of rent. Please note that if your booking is through Airbnb a security deposit does not apply. 

Pets

Pets are only permitted in pet friendly properties. A breach of this clause will result in immediate forfeiture of the Security Deposit and may result in eviction. 

Smoking

Smoking or vaping of any kind is not permitted inside the Premises. Designated outdoor smoking areas (if applicable) must be used with proper disposal of cigarette butts. Non-compliance will incur a cleaning fee and/or bond deduction.

Subletting

Subletting or assigning this Agreement to another party is strictly prohibited. 

Right of Entry

The Host reserves the right to access the Premises with appropriate notice forthe purposes of inspection, maintenance, or emergencies, as per state legislation. Unlawful activity or breaches of this Agreement may result in immediate termination. 

Cleaning & Condition

Guests must maintain the Premises in a clean, orderly, and respectful manner. The Guest is expected to return the Premises in a "ready-to-rent" state. Excessive mess, food waste, spills, or odours (e.g. seafood, curry, smoking) will result in additional cleaning fees of no less than $100 AUD deducted from the bond. Any damage, staining, or breakage will also be charged accordingly. 

Waste Management

All rubbish and recyclables must be placed in the correct bins as directed. Excess waste left on site or failure to follow council bin regulations may result in cleaning fees or waste disposal charges. 

Use of BBQ and Outdoor Facilities

If a BBQ is provided, it must be cleaned thoroughly after use. Failure to do so will result in a $50 cleaning fee. BBQs must not be used during total fire bans and must be supervised at all times. Any damage caused by improper use is the Guest’s responsibility. 

Disturbances and Conduct

The Guest agrees to behave in a lawful, courteous, and respectful manner at all times. Large gatherings, parties, loud music, or antisocial behaviour are strictly prohibited and grounds for immediate termination without refund. 

Host Liability

The Guest and any persons they allow on the Premises release the Host from liability for any injury, loss, or damage arising from occupancy. The Host’s insurance does not cover the personal property of the Guest. 

Legal Fees and Costs

If enforcement action is required, the Guest agrees to pay any reasonable legal or collection fees incurred by the Host in connection with a breach of this Agreement. 

Use of Premises

The Premises are for residential holiday use only. No commercial activity may take place on the Premises, including product sales, services, or promotional shoots unless expressly agreed in writing. 

Illegal Activity

Any illegal activity—including but not limited to illicit drug use, violent behaviour, or unlawful conduct—will result in immediate eviction and notification to relevant authorities. 

Left Items

The Host will make reasonable efforts to return any items left behind. If unclaimed within 14 days, the Host reserves the right to dispose of or retain items. The host will charge a return fee depending on the time spent to locate item and any return postage costs.  

 Governing Law

This Agreement shall be governed by the laws of South Australia.

All intellectual property rights are reserved. You may access this from South Coast Stay for your own personal use subjected to restrictions set in these terms and conditions. 

You must not:  

  • Republish material from South Coast Stay
  • Sell, rent or sub-license material from South Coast Stay
  • Reproduce, duplicate or copy material from South Coast Stay
  • Redistribute content from South Coast Stay

This Agreement shall begin on the date hereof. 

Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. South Coast Stay does not filter, edit, publish or review Comments prior to their presence on the website.


Comments do not reflect the views and opinions of South Coast Stay, its agents and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions.
